The right model is the one that puts each risk (feedstock, permit, technology, labor, product market) with the party best able to manage it, at a level of control the governing body will accept.

Key takeaways

Two decisions hide inside “operating model”: how the facility gets built (the delivery method) and who runs it day to day (the operating arrangement). Make them separately, then check that they fit together.

Owning and operating gives the most control and keeps the most risk. Contracting for processing gives the least of both.

Design-build and design-build-operate trade design control for a single point of accountability. Check that your state lets your agency use them for a solid waste facility.

A contract operator on a publicly owned site is a common middle path: the public keeps the asset and the permit and buys operating skill.

Write the risk allocation table before you write the procurement. It tells you which model you are really buying.

Whatever the model, someone must hold the permit, keep the pathogen and emissions records and answer the neighbor who calls.

Two decisions, not one

Councils often ask “who will run it?” before anyone has asked “how will it be built?” Separate the two.

Delivery method covers design and construction:

Design-bid-build. The agency hires an engineer to design the facility, then bids construction to contractors. The agency owns the design and carries the risk that design and construction do not fit together.

Design-build. One entity designs and builds under one contract. California, for example, gives cities and counties general authority to use design-build for defined project types under Public Contract Code section 22160 and following. Under section 22161, for a city or county that operates solid waste facilities, “project” includes regional and local solid waste facilities. Section 22162 requires governing body approval, sets a minimum project size, allows award on low bid or best value, and requires a conflict-of-interest policy. The chapter states that it gives no preference to design-build over other methods, and it is set to be repealed on January 1, 2031. Other states differ, so confirm your own authority.

Technology supply plus local construction. The agency buys the composting system (aeration, covers, controls, training) from a supplier and builds the pad and utilities under a separate contract. This is common for covered aerated static pile (ASP) systems, where the supplier’s equipment sits on a site the owner prepares.

Operating arrangement covers who receives, mixes, builds piles, monitors, screens and sells: public staff, a contract operator, the design-build contractor, a private processor on its own site, a partner, or a regional agency.

The seven models at a glance

Shared among members

The table is a general pattern, not a rule. Contracts can move any risk in any direction, and the municipal buyer’s guide shows how the model choice feeds the rest of the decision.

Model by model: fits when, does not fit when

Own and operate

The agency buys the system, employs the operators and markets or uses the compost.

Fits when the agency already runs a landfill, transfer station or leaf compost pad, has a site with room to grow, and wants to control feedstock rules and the finished product (for example, to supply parks or meet a procurement duty). SG’s profile of the City of San Diego’s Miramar Greenery describes a city composting on its own landfill site that, after adding food waste and evaluating several methods, ran a pilot-scale demonstration of an SG MOBILE® System with a GORE® Cover (profile).

Does not fit when the agency cannot recruit or keep trained operators, or when the governing body will not accept performance risk on its own books. Read the staffing and operator training guide before budgeting this model.

Public owner, contract operator

The agency owns the site, the system and usually the permit, and hires a firm to run it.

Fits when the agency wants to keep the asset but buy operating skill. SG’s profile of the Staten Island Compost Facility lists the New York City Department of Sanitation as owner and Denali Water Solutions as operator, and says Denali has run the site since 2007 through a contract with the department (profile).

Does not fit when the agency has no one to manage the contract. A contract operator still needs an owner who reads the batch records, enforces performance terms and plans capital replacement.

Design-build with public operation

Fits when schedule matters, the scope is clear and the agency will run the facility itself. One contract removes the gap between designer and builder.

Does not fit when the agency wants to control design details, or when state law does not authorize design-build for this facility type or size.

Design-build-operate

Fits when the agency wants one party accountable for performance over a long term and can write measurable standards: tons processed, pathogen reduction records, emission limits, product quality.

Does not fit when the market has few qualified bidders for the full package, or when the agency would lose the knowledge to take the facility back at the end of the term. Long terms also lock in a technology choice.

Contract processing at a private facility

The agency delivers organics to a privately owned facility and pays a tip fee or a contract rate.

Fits when tonnage is small or uncertain, no workable public site exists, or a private facility is close enough that haul distance stays reasonable.

Does not fit when the agency needs guaranteed long-term capacity it does not control, or when the nearest facility is far away. A contract is only as secure as the facility’s permit.

Public-private partnership

A broad label for deals in which a private partner finances, builds or runs a facility on public land, often with a feedstock commitment from the agency.

Fits when the agency has land and tonnage and a partner has capital and operating experience. Does not fit when the agency cannot commit tonnage for the term, or when the deal structure is too complex for the facility’s size.

Regional authority

Several agencies create or join a joint body that owns and runs a shared facility. The regional facilities guide covers this model in depth. Canadian regional districts work in a similar way: SG’s Grand Forks profile describes the Regional District of Kootenay Boundary, a British Columbia regional government, composting at the Grand Forks Landfill and adding food scraps and biosolids to its program (profile).

Fits when no single member has enough tonnage or a suitable site. Does not fit when members cannot agree on governance, cost sharing or host-community terms.

Who carries which risk

Use this table as the starting point for a risk workshop with finance, legal, public works and the operator, whoever that will be.

Risk

Own and operate

Contract operator

Design-build-operate

Contract processing

Tonnage arrives below forecast

Agency

Agency

Agency, through any minimum tonnage commitment

Agency, if the contract has a minimum

Contamination in carts

Agency

Agency, unless the contract sets limits and charges

Shared, by contract limits

Processor rejects or surcharges loads

Permit compliance

Agency

Shared; Residents and elected officials hold the city responsible whoever signs the permit, so keep the right to see operating records and to step in. And in California, SB 1383 obligations stay with the jurisdiction: CalRecycle says that if a jurisdiction delegates responsibilities to a public or private entity, other than a joint powers authority, it is still ultimately responsible for compliance (CalRecycle enforcement questions and answers).

How to choose: a working sequence

List what is fixed. Site ownership, permits in hand, existing staff, debt capacity, any state mandate and its deadline.

Forecast tonnage as a range. If the low case would leave a public facility underused, contract processing or a regional partner deserves a serious look. The tonnage forecasting guide shows the method.

Fill in the risk table above for your two or three most likely models.

Check legal authority. Confirm which delivery methods your agency may use for a solid waste facility and whether a long operating contract needs special approval.

Test the technology before you lock in a model. A pilot on your site tells you how much operator attention the method needs, which affects whether staff or a contractor should run it. SG’s pilots and demos page describes pilots that run actual batches of the owner’s feedstock to generate data for permits, grants or board approval.

Compare lifecycle cost by model, not purchase price. The lifecycle cost guide lists the drivers, and SG’s Part 1 article on infrastructure decisions gives one supplier’s view of long-term cost.

Choose, then procure. The procurement routes guide matches each model to a solicitation method.

Where a technology supplier fits in each model

In most models, someone still buys a composting system. Sustainable Generation (SG) supplies covered ASP systems using SG Advanced Composting™ Technology with the GORE Cover, positive aeration and the SG COMPOST CONTROL™ System. Its pages describe project initiation services (feasibility studies, site selection, financial and technical evaluation, grant support and RFP assistance), facilities planning and permitting support, design and engineering with installation guidance, pilots, a leasing program for the SG MOBILE System, and operator training and support, including an extended service contract.

SG’s pages do not describe SG as a facility operator or as a design-build-operate contractor. An agency that wants one of those models should plan to procure the operator or the full-service contractor separately and ask suppliers how their equipment and training would work under that arrangement. For covered ASP, the systems comparison guide explains which SG system suits which site.

FAQ

Is design-build-operate cheaper than owning and operating?

Not necessarily. A design-build-operate contractor prices in the risks it takes on, so the agency pays for that transfer. It can still be the better value when the agency lacks operating staff or wants one accountable party. Compare models on lifecycle cost with the same tonnage, the same performance standards and the same period, and include the cost of managing the contract.

Can we start with contract processing and build our own facility later?

Yes. Many agencies send material out while they find a site, secure permits and arrange funding. Keep the contract term short enough to switch, avoid minimum tonnage terms that outlast your build schedule, and collect data on your own feedstock during that time. A pilot on your future site can run in parallel.

Who should hold the permit when a contractor operates a public site?

It depends on your state’s rules and the contract. Many public owners keep the permit so the asset and its approvals stay public if the operator changes. The contract should then require the operator to meet every permit condition, keep the required records, report incidents promptly and give the agency full access to data.

Does a regional authority remove risk from member cities?

It shares risk; it does not remove it. Members usually commit tonnage, money or both, and they answer to residents who live near the shared site. In California, CalRecycle treats duties delegated to a joint powers authority differently from those delegated to other entities, so check how your agreement assigns SB 1383 responsibilities.

What should a contract operator agreement include?

Performance standards (tons, pathogen reduction records, emission and permit conditions, product quality), staffing and training requirements, reporting and data access, maintenance and capital replacement duties, contamination handling, complaint response, insurance, termination and step-in rights, and handover terms at the end of the contract.

Next step

If you are weighing models, a pilot gives you the operating data each option needs: how many tasks a batch takes, what the process records look like and how the feedstock behaves. See SG’s pilots and demos page, or start with its consulting services for feasibility and site work.

Related guides

Regional and Shared Compost Facilities: How Cities Partner

Municipal Procurement Routes for a Composting System

Composting vs Landfilling Organics: How to Compare the Cost per Ton

Composting System Buyer’s Guide for Municipalities

Compost Facility Staffing and Operator Training Guide

All guides for cities and counties

← Composting Guide for Municipalities and Public Works

← All commercial composting guides

Test covered ASP on your own feedstock

An SG Mobile® pilot runs real batches of your material and produces the data a permit, grant or board decision asks for.

Start a pilot · Talk to the SG team

{"@context":"https://schema.org","@graph":[{"@type":"Article","@id":"https://sustainable-generation.com/commercial-composting-guide/municipal-compost-operating-models/#article","headline":"Municipal Compost Operating Models (Own, Contract or Partner)","description":"Own and operate, design-build, design-build-operate, contract processing, public-private partnership or regional authority: which model fits a city or county.","url":"https://sustainable-generation.com/commercial-composting-guide/municipal-compost-operating-models/","mainEntityOfPage":"https://sustainable-generation.com/commercial-composting-guide/municipal-compost-operating-models/","author":{"@id":"https://sustainable-generation.com/#organization"},"publisher":{"@id":"https://sustainable-generation.com/#organization"},"inLanguage":"en-US"},{"@type":"FAQPage","@id":"https://sustainable-generation.com/commercial-composting-guide/municipal-compost-operating-models/#faq","mainEntity":[{"@type":"Question","name":"Is design-build-operate cheaper than owning and operating?","acceptedAnswer":{"@type":"Answer","text":"Not necessarily.
